Welcome to Lingo Monkey. These Terms and Conditions ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Services.

2. Changes to Terms

We may modify these Terms at any time. Changes take effect when posted on this page. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services in any manner that infringes the rights of others, violates applicable laws, or disrupts the operation of the Services.

5. Intellectual Property

All content and materials provided through the Services are the intellectual property of Lingo Monkey or its licensors. You may not copy, modify, reproduce, distribute, or create derivative works without our prior written consent, except as permitted by law.

6. Subscription & Billing

  • Auto-renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
  • Pricing: Prices may change. Any change will apply to the next billing cycle and will be communicated in advance where required by law.
  • Trials & promotions: If offered, trials convert to paid subscriptions unless cancelled before the trial ends. Promotional terms apply only for the stated period.

7. Payment Processing (Paddle)

Payments for web purchases are processed by Paddle, our merchant of record. Paddle handles billing, invoicing, applicable taxes, and provides customer receipts. Your checkout and subscription management links may be provided by Paddle (for example, in your receipt email).

Note: If you purchase via the Apple App Store or Google Play, billing, refunds, and cancellations are managed by those stores under their policies.

8. Taxes & Invoices

Applicable taxes (e.g., VAT/GST) are determined by your location and will be shown at checkout. Invoices/receipts are issued by the payment processor (e.g., Paddle) and sent to your provided email address.

9. Refund & Cancellation Policy

9.1 Cancellations

  • You can cancel anytime in your account settings or via the subscription management link provided by the payment processor (e.g., in your Paddle receipt).
  • Cancellation stops future renewals. You will retain access to paid features until the end of the current billing period unless otherwise stated.

9.2 Refunds

  • We offer a 14-day money-back guarantee from the subscription start date. If you are not satisfied, request a refund within 14 days of your initial subscription.
  • Refunds are typically returned to the original payment method. Processing times may vary (e.g., 5–10 business days) depending on your bank or payment provider.
  • For payments processed by Paddle, you may request a refund by contacting our support or following the instructions in your Paddle receipt/portal.
  • If you purchased through the Apple App Store or Google Play, refunds must be requested through the respective store in accordance with their policies.

9.3 Limitations & Fair Use

  • The 14-day guarantee is intended for first-time purchases of a given plan. We may decline repeat or abusive refund requests.
  • We do not provide prorated refunds for partial unused periods unless required by law.
  • Chargebacks or payment disputes may result in immediate suspension or termination of access.

10. Limitation of Liability

To the fullest extent permitted by law, Lingo Monkey shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

11. Termination

We may suspend or terminate your access to the Services if you violate these Terms or if required for legal or security reasons. Upon termination, your right to use the Services will cease immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine. This policy does not limit any mandatory consumer rights you may have under the laws of your country of residence.
